Sail in Asia Outdoor Education Programme Terms & Conditions
1. General Booking Conditions
Sail in Asia Outdoor Education Programmes are specially designed for International Schools, educational institutions, and youth groups. We work closely with each school or organization to recommend and customize activities that best suit the educational objectives, age group, and experience level of the participants.
All bookings are made and accepted subject to the Terms & Conditions set out in this document.
Sail in Asia Co., Ltd. is a company incorporated in Thailand. Any contract entered into with Sail in Asia Co., Ltd. shall be governed by and construed in accordance with the laws of the Kingdom of Thailand.
By confirming a booking and making payment, the Client acknowledges that they have read, understood, and accepted these Terms & Conditions.
2. Payment Terms
2.1 Booking Deposit
A non-refundable deposit of 30% of the total programme fee is required to secure the booking.
A booking is not confirmed until the deposit has been received and cleared in Sail in Asia’s bank account.
2.2 Payment Schedule
Unless otherwise agreed in writing, payments shall be made as follows:
● Payment 1: 30% deposit upon booking (approximately 6 months before the
programme)
● Payment 2: 40% of the total fee, due no later than 90 days before the programme
start date
● Payment 3: Remaining 30%, due no later than 30 days before the programme start
date
Failure to complete all payments by the due dates may result in cancellation of the booking. Sail in Asia reserves the right not to deliver the programme until full payment has been received.
2.3 Late Payments
Late payments may result in cancellation of the booking unless an alternative arrangement has been agreed in writing by both parties.

The Client is responsible for all bank charges, transfer fees, exchange rate differences, and any intermediary banking costs. The full invoiced amount must be received by Sail in Asia.
4. Cancellation Policy
All cancellations must be submitted in writing by email.
Cancellation requests should be sent to: ceo@sailinasia.com & adventure@sailinasia.com
Refunds will be calculated based on the date written notice is received.

Refunds, where applicable, will be processed after deducting any applicable bank charges or transaction fees.
5. Bad Weather
Sailing activities are naturally dependent on weather conditions. However, it is uncommon for programmes to be significantly affected.
If weather conditions are considered unsafe by Sail in Asia’s qualified instructors or management, sailing activities may be postponed, modified, or cancelled to ensure the safety of participants, instructors, and vessels.
Where practical, alternative shore-based educational activities or classroom sessions will be provided.
No refund or compensation will be payable for sailing time lost due to adverse weather conditions.
6. Force Majeure
Sail in Asia shall not be liable for any delay, cancellation, alteration, or failure to perform its obligations where such events arise from circumstances beyond its reasonable control, including but not limited to:
● Acts of God
● Severe weather
● Natural disasters
● Epidemics or pandemics
● Government restrictions
● Civil unrest
● War or terrorism
● Strikes or labour disputes
● Port closures
● Any other unforeseen event beyond Sail in Asia’s control
Where reasonably possible, Sail in Asia will work with the Client to reschedule the programme or provide suitable alternatives. Any additional costs resulting from such events shall be the responsibility of the Client unless otherwise agreed.
7. Programme Changes
Sail in Asia reserves the right to amend programme schedules, sailing routes, activities, instructors, vessels, accommodation, or venues where necessary due to operational, weather, safety, or logistical requirements.
Any changes will be made with the best interests and safety of participants in mind.
8. Safety
Participant safety is Sail in Asia’s highest priority. All participants must follow the instructions of Sail in Asia instructors and staff at all times.
9. Insurance
Schools and participants are strongly encouraged to arrange adequate travel, medical, accident, and personal belongings insurance before attending the programme.
Sail in Asia accepts no responsibility for loss, theft, or damage to personal property.
10. Liability
Sail in Asia exercises reasonable care and skill in delivering its programmes.
Except where liability cannot legally be excluded under Thai law, Sail in Asia shall not be liable for indirect, consequential, or incidental losses arising from participation in the programme.
The Client acknowledges that sailing and outdoor adventure activities involve inherent risks and accepts participation on that basis.
11. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Kingdom of Thailand.
Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the Thai courts.
12. Medical Information & Fitness to Participate
The Client (School or Organization) is responsible for ensuring that all participants are medically fit to take part in the Outdoor Education Programme. The Client must provide Sail in Asia with any relevant medical information, including allergies, medical conditions, dietary requirements, medications, physical limitations, or other special needs that may affect a participant’s safety or participation.
Participants requiring medication during the programme must bring sufficient supplies and provide clear instructions for its administration where applicable.
Sail in Asia reserves the right to refuse participation to any individual whose medical condition may pose an unacceptable safety risk to themselves or others if appropriate information has not been disclosed in advance.
13. Parental Consent (Participants Under 18 Years of Age)
For all participants under the age of 18, the Client is responsible for obtaining written consent from a parent or legal guardian prior to the programme.
The consent should include permission for participation in sailing and outdoor adventure activities, emergency medical treatment if required, and acknowledgement of the inherent risks associated with such activities.
The Client confirms that all necessary parental permissions have been obtained before the programme commences.
14. Photography & Media Consent
During the programme, Sail in Asia may take photographs and videos for educational, promotional, and marketing purposes, including use on websites, social media, brochures, and other promotional materials.
The Client is responsible for informing Sail in Asia, in writing before the programme begins, of any participants who do not consent to being photographed or filmed. Sail in Asia will make reasonable efforts to respect these requests.
15. Participant Behaviour
All participants are expected to behave responsibly and respectfully towards instructors, staff, fellow participants, vessels, equipment, accommodation providers, and members of
the public.
Participants must comply with all safety instructions and programme rules at all times. Bullying, harassment, discrimination, violence, possession or use of illegal substances,
excessive alcohol consumption, vandalism, or any behaviour that endangers the safety or enjoyment of others will not be tolerated.
Sail in Asia reserves the right to remove any participant from activities or the programme if their behaviour is considered unsafe, disruptive, or inappropriate. Any costs arising from such removal shall be the responsibility of the Client, and no refund will be given.
16. School Responsibilities
The School or Organization agrees to:
● Provide accurate participant information, including medical details, emergency contacts, and any special requirements.
● Ensure that all participants have appropriate parental or guardian consent where required.
● Ensure participants arrive with suitable clothing, footwear, and personal equipment as advised by Sail in Asia.
● Ensure that accompanying teachers or group leaders maintain appropriate supervision of students outside scheduled Sail in Asia instructional activities unless otherwise agreed.
● Inform Sail in Asia promptly of any changes to participant numbers, programme requirements, or special circumstances.
● Ensure participants understand and comply with Sail in Asia’s safety procedures, instructions, and code of conduct.
The School or Organization acknowledges that cooperation between school staff and Sail in Asia personnel is essential to maintaining a safe, enjoyable, and educational experience for all participants.
